Zeepay sues MTN Ghana and MMFL for GH¢15m over mobile money wallet dispute

Ghana GuardianSource

Zeepay Ghana Limited and its managing director, Andrew Takyi-Appiah, are seeking a total of GH¢15 million in damages from Scancom PLC, which operates MTN Ghana, and Mobile Money Fintech Limited (MMFL). The case was filed at the High Court in Accra on 23 October 2026 and centres on the registration of Zeepay’s corporate mobile money wallet in Mr Takyi-Appiah’s name. Zeepay is demanding general damages for alleged breach of contract, while Mr Takyi-Appiah is seeking GH¢10 million in general damages and GH¢5 million in exemplary damages. According to the statement of claim, Zeepay subscribed to an MTN Mobile Money corporate wallet, known as an OVA wallet, around 2022/2023. The company later discovered that the wallet had been registered in Mr Takyi-Appiah’s name, despite the subscription documents and Know Your Customer (KYC) records being issued in Zeepay’s name. The company wrote to the defendants on 21 November 2023, asking them to transfer ownership of the wallet to Zeepay. It said it provided the required documentation but that the defendants failed to act, despite repeated reminders continuing until August 2026. The wallet was still registered in Mr Takyi-Appiah’s name when the proceedings were started, the plaintiffs said. #### Impact on managing director Mr Takyi-Appiah claims the registration has caused him pain, distress and reputational damage. He said he had been joined to litigation involving Zeepay because his name remained on the wallet’s ownership records. The plaintiffs said courts had refused to remove him as a party in all of Zeepay’s pending cases at the High Court in Accra for that reason. They said the defendants had sought to justify the use of his name by describing him as the wallet’s handler. However, Zeepay and Mr Takyi-Appiah argued that being the holder of an OVA wallet did not necessarily mean that person was its owner. The defendants’ conduct was described by the plaintiffs as “oppressive, arrogant and a complete disregard of the rights” of both claimants. #### What Zeepay is asking the court to order The plaintiffs want declarations that registering the wallet in Mr Takyi-Appiah’s name was wrongful and unlawful, that the defendants breached their duty to Zeepay, and that they are responsible for any harm suffered by him. They are also seeking an order requiring the defendants to remove his name from the wallet and comply with Zeepay’s November 2023 instructions. Other claims include general damages for breach of contract, GH¢10 million in general damages and GH¢5 million in exemplary damages for Mr Takyi-Appiah, as well as legal costs and any further relief the court considers appropriate. The writ requires the defendants to enter an appearance within eight days of being served. The allegations have not been tested in court.
